1. Not medical advice and no clinical relationship
Tsupylo Vitalii is not a licensed physician, pharmacist, nurse, psychologist or healthcare institution. KinPulse is intended solely to help families organise care. It is not intended for, and must not be used for, the diagnosis, prevention, monitoring, prediction, prognosis, treatment or alleviation of any disease or injury, and is therefore not a medical device within the meaning of Regulation (EU) 2017/745. KinPulse does not provide medical, nursing, pharmaceutical, nutritional, psychological or legal advice and does not monitor your health. Nothing in the App, on the website, in notifications or in AI responses creates a doctor–patient or any other professional relationship.
All health-related content in KinPulse — measurement and activity catalogues, descriptions, starter templates, tips and AI responses — is general information for organising care. It is not tailored to your situation, may be incomplete or outdated and must not be used as a basis for starting, stopping or changing any medication, dose, treatment or diet. Always follow the instructions of your treating clinicians and the official information leaflet of each medication, and consult a qualified professional before making any health decision. Never disregard or delay professional advice because of something you read in KinPulse.
2. Not an emergency service
The SOS feature sends an alert to the members of the Family Space you select. It does not contact police, ambulance, fire or any other emergency or medical service, is not monitored by any person and is not an alarm or telecare system. Delivery depends on your device, network, permissions, the push services of Apple, Google and Expo and on your family members having their devices available; alerts may be delayed, lost or unread. A “sent” status means our server accepted the alert, not that anyone has seen it. The location included in an alert is a single reading that can be unavailable or inaccurate. Phone buttons only open your device’s dialer.
If you or someone else is in immediate danger, needs urgent medical help or is at risk of harming themselves, call your local emergency number immediately (112 throughout the European Union and in Ukraine, 103 for an ambulance in Ukraine, 911 in North America) or go to the nearest emergency department. Do not rely on KinPulse in an emergency.
3. AI Assistant
The AI Assistant is an automated system based on a large language model provided by a third party (OpenAI). You are not communicating with a human. Such models predict text and can produce answers that are confident but incorrect, incomplete, biased, outdated or fabricated (“hallucinations”), including when reading photos of medications, documents or symptoms. The AI Assistant does not know your medical history, cannot examine anyone and currently has no access to your Care Data unless you type it.
Responses of the AI Assistant are general information only. They are not medical advice, diagnosis, prescription or triage, and they must never replace consultation with a qualified professional or a call to emergency services. You are responsible for verifying any information before acting on it and for the content you choose to send. To the fullest extent permitted by law, we accept no liability for decisions taken on the basis of AI responses.
4. Reminders and notifications
Care reminders are sent on a best-effort basis through third-party push services and may be delayed, duplicated, suppressed by your device’s battery or notification settings, or not delivered at all. A reminder marked as “taken” or “done” reflects only what a user tapped, not what actually happened. KinPulse is not a medication-dispensing or monitoring system. Keep an independent, reliable routine for anything time-critical, for example a pill organiser, a written schedule or a clinician-approved plan, and verify important doses with the prescriber or pharmacist.
5. User-entered records
Care Data in KinPulse is entered by you and the members of your Family Space. KinPulse does not verify it against medical records, devices or pharmacies and cannot detect errors, omissions, interactions or dangerous values. Records can be wrong, outdated or entered for the wrong person. Review entries regularly, confirm them with professionals when it matters and do not treat the App as an official medical record. Any descriptions shown next to measurements or activities are generic and do not indicate whether a value is normal or safe for a particular person.
6. Information about other people
When you record or share information about another person, you are responsible for having the right to do so and for the consequences of sharing it with your Family Space. KinPulse cannot verify relationships or authority and is not responsible for what the members you invite do with the information they see.
7. Third-party services and links
KinPulse relies on third-party services (device operating systems, push services, hosting, e-mail, image storage, the AI model provider and the app stores) and may link to third-party websites such as map or store pages. We do not control these services and are not responsible for their availability, accuracy, security or content. Links do not imply endorsement.
8. Availability and accuracy
The App and website are provided “as is” and “as available”. We do not guarantee that they will be uninterrupted, timely, secure or free of errors, that data will never be lost or that any content is accurate or complete. Parts of the App may be in development or marked as demo or beta and may change or disappear. Keep your own copies of information that matters to you.
9. Limitation of liability
To the maximum extent permitted by applicable law, Tsupylo Vitalii is not liable for any loss, injury, damage or expense arising from reliance on KinPulse, its content, reminders, SOS alerts or AI responses, from failures of third-party services, or from the acts or omissions of other users. Nothing in this Disclaimer excludes or limits liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence, for fraud or wilful misconduct, or mandatory consumer rights.
